TERMS OF USE

The terms of this agreement (the “Terms”) determine the relationship between you (“user” or the “customer”, including “member” and “non-member”) and My Culture Inc. (“we”, “us”, “our” and “MyCultureis”) regarding your use of My Culture Inc.’s website, application (the website and application, “site”), products and services and payment processing services. By accessing and using this site, you agree to be bound by these Terms. In addition, when using particular services or any text, images, photos, location data, and other materials uploaded on this site (collectively, the “content”), users shall be subject to any posted rules applicable to such services or materials that may contain terms and conditions in addition to those in these Terms. All such guidelines or rules are hereby incorporated by reference into these Terms.
By using MyCultureis services, you agree to these conditions. Please take the time to read them carefully and understand your rights and restrictions.

1. ELIGIBILITY
By using the services, you warrant that all the information you supply us true, complete and accurate. You may not provide any false information about yourself, someone or something else. You must be 13 years of age or older to register and use our site. You may be restricted to access our services if you have been previously banned by MyCultureis.

2. USER ACCOUNT AND ACCOUNT TERMINATION
In order to use some of the features of our services, you are required to create an account and provide certain information about yourself.
You are fully responsible for any and all use of your account, including maintaining the confidentiality of your password. You agree not to disclose your password to any third party other than you nor access the account of another member at any time.
We reserve the right to close your account at any time for any reason (specified or unspecified) and without notice or liability of any kind. For example, we may terminate your usage for suspected fraudulent, abusive, or illegal activity. You may terminate usage with MyCultureis by closing your account. After closing your account, the content that you have posted on the site may still appear on the site. We have no obligation to remove your content.

3. CONTENT
You own your content and information you post on the services. By posting any content on or through the services, you hereby permanently grant us transferable rights to use your content for any purpose. We may use, modify, translate, publicly display, reproduce, or distribute your content in any media format. We own the MyCultureis content and the services, which are protected by copyright, trademark, patent, trade dress, and other proprietary rights and laws of the Republic of Korea. We grant you limited license to reproduce and display the MyCultureis content solely for your personal use in viewing the site or using the services. You may not modify, reproduce, distribute, create related works, publicly display or in any way exploit any of our content without authorization.

4. PRODUCT DESCRIPTIONS
MyCultureis attempts to be as accurate as possible. However, we cannot fully guarantee that the product descriptions or other content of any service is accurate, complete, reliable, current, or error-free. As our products are cultural experience services, outcome of the services can vary according to weather, traffic, other customers, political situation, etc. and MyCultureis is not responsible for such changes.

5. USE OF SERVICES
You agree to take full responsibility in checking all information given on our site as well as in making sure that all information you submit to MyCultureis and/or any third party including, but not limited to, option, date, time, and quantity, for using services provided by MyCultureis and/or any third party is correct and appropriate. Any losses or damages caused by not doing so will not be MyCultureis’s or any third party’s responsibility. You must check all the information regarding the services that you purchase provided on the site and in the confirmation email you will receive upon completion of booking the services. Any losses or damages caused by not doing so will not be MyCultureis’s or any third party’s responsibility.

6. PAYMENTS, CANCELLATIONS AND REFUND POLICY
There are a few types of payment methods available on our site; Credit Card, PayPal, and so on. There is no charge or service fee for processing credit or debit card payments. Full payment by credit/debit card is required to make a reservation.
Some experience bookings are eligible for a full refund if you cancel no later than 48 hours (or 72 hours) from the date of your experience product. We will only honor cancellations and refunds according to the specific policy for the experience product. You are responsible for checking each individual cancellation and refund policy on the site before completing your purchase. Refund for cancellation can be applied at Reservation list in ‘My page’.
No exceptions are made to the cancellation policy of each service for any reason, including neither personal or medical, weather or other forces of nature, terrorism, civil unrest, strikes, international or internal(domestic) flight cancellations, or any other reason beyond our control. We therefore strongly recommend that you purchase a travel insurance to protect yourself from unexpected circumstances that may cause you to cancel your booking.

7. LIMITATION OF ROLES AND LIABILITY
MyCultureis only acts as an agent in booking services as respective service providers. Therefore, we do not take liability for actions, inconveniences, or accidents caused by the service providers. We will only provide interpretation in resolving the dispute between you and the service providers. We will not be responsible for any action including but not limited to reimbursement, compensation, and insurance payment.
We shall not be responsible for any unexpected situations (e.g., food allergies, injuries during an exercise, etc.) that occurred during the use of services between you and the service providers.
If the content posted by you infringe, misappropriate or violate moral rights or other proprietary or intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation, we may delete it, or take other necessary actions, in its sole discretion. In addition, the third parties shall not be held liable to the company due to the lack of sales effect intended by them.

8. WARRANTY DISCLAIMER
The MyCultureis services and all related information, content, materials, products including software and other services included on or otherwise made available to you through the services are provided by MyCultureis on an “as is” and “as available” basis, unless otherwise specified in writing. We make no representations or warranties of any kind, express or implied, as to the operation of our services, or the information, content, materials, products including software or other services included on or otherwise made available to you through our services, unless otherwise specified in writing. You expressly agree that your use of our services is at your sole risk.
To the full extent permissible by applicable law in the Republic of Korea, MyCultureis disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. We do not warrant that our services, information, content, materials, products including software or other services included on or otherwise made available to you through our services, our servers or electronic communications sent from MyCultureis are free of viruses or other harmful components. We will not be liable for any damages of any kind arising from the use of any service, or from any information, content, materials, products including software or other services included on or otherwise made available to you through any service, including, but not limited to direct, indirect, incidental, punitive, and consequential damages, unless otherwise specified in writing. Fulfillment of the service promised is under the service provider’s responsibility.

9. RESTRICTIONS
We reserve the right at all times to investigate and take appropriate action at our sole discretion against anyone who violates this provision. MyCultureis reserves the right (but not the obligation) to remove or edit such prohibited content or activity below:
a) Violations and infringements of other users’ rights, privacy or intellectual property
b) Racism, sexual discrimination, or any type of offensive or malicious act against any group or individual
c) Creating false information, including using a false email address, illusive acts, invasion of privacy, infringing of intellectual property rights, misleading information or activities
d) Generating promotion or commercial information without MyCultureis’s prior consent
e) Provoking or facilitating illegal or unlawful activities
f) Use of other users’ or MyCultureis’s content, including, but not limited to modifying the content for commercial purpose
g) Biased or malicious commenting for the benefit of another party
h) Solicitation of personal information from other users

10. PRICING
Pricing is subject to change without prior notification. Prices are listed on each individual product page. Please read the terms of each product carefully. All taxes (sales, VAT) are already included in price. These taxes are not refundable for tourists.

11. PRIVACY POLICY
All the information you provide MyCultureis is subject to our Private Policy. By agreeing to the terms and conditions, you are agreeing to the use of the personal information that you provide us. Refer to our Privacy Policy for more details.

12. COPYRIGHT POLICY
All the content and information seen on MyCultureis, including text, graphics, logos, icons, images, audio and video clips, etc. are all the property of MyCultureis and its affiliates. We respect all intellectual property, if you believe your work or our work has been copied and constitutes copyright infringement, please contact us at contact@mycultureis.com.

13. PARTNER SITES
Other parties aside from MyCultureis operate stores, provide services, or sell product lines on this site. We provide links to parties other than MyCultureis on the site. We are not responsible for examining or evaluating these sites, and we do not warrant the offerings of, any of these businesses or individuals or the content of their sites. We do not assume any responsibility or liability for the actions, product, and content of all these and any other third parties. You should carefully review their privacy statements and other conditions of use.

14. DISPUTES AND APPLICABLE LAW
a) Any dispute or claim relating in any way to your use of MyCultureis, or to any products or services sold through www.mycultureis.com will be resolved by binding arbitration, rather than in court. All users of this site agree that any dispute resolution proceedings will be conducted only on an individual basis and not in an experience product, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration, all users waive any right to a jury trial. MyCultureis and the user also agree that you or we may bring suit in court for infringement or other misuse of intellectual property rights.
b) By using any MyCultureis services, you agree that all disputes and legal actions of any sort between you and MyCultureis are governed by the law of the Republic of Korea.

15. CHANGES TO THIS TERMS OF USE
MyCultureis expressly reserve the right to change the Terms of Use without prior notice. You acknowledge and agree that it is your responsibility to review this site and the Terms of Use from time to time and to familiarize yourself with any modifications. Your continued use of this site after such modifications will constitute acknowledgement of the modified Terms of Use and agreement to abide and be bound by the modified Terms of Use.
